Order/Return Policy and Terms
Orders
Orders can be easily placed on the ToeOut Performance website through
our secure encrypted connection. Ordering can also be done by
e-mail, phone, fax, or postal mail.
Credit cards accepted include: Discover, Visa, MasterCard, and American
Express. We do not ship COD. California residents will be charged
7.75% sales tax on all orders.
Shipping charges will be added to all orders. See below for more
information on shipping options.
All purchases are subject to product availability. Any item not
in stock will be placed on back order and shipped as soon as it becomes
available. Backorders will not be charged until the day of shipment.
Back Orders
Backordered products will be shipped as soon as possible, unless we
are otherwise directed when you place the order. If an item is backordered
you will be informed immediately and given an estimated ship date. Credit
cards will not be charged for back ordered items until the product is
available for shipment.
Special Orders
Special orders must be prepaid and are not returnable or refundable.
Shipping
Standard practice is to ship by UPS Ground Service the next business
day after we receive an order. Three additional UPS shipping options
are available: "Next Business Day" (red label), "2nd Business Day" (blue
label), and "3rd Business Day" (orange label). As with ground shipping,
standard practice for these three options is to ship the next business
day after we receive the order. To receive the fastest service, place
a phone order BEFORE 12:00 noon Pacific Time. We will inform you at
the time you place such a phone order if same day shipment is possible.
Items too large for UPS are shipped by truck.
Return and Exchange Policy
We always strive to provide 100% satisfaction. All items except Special
Orders can be returned within 30 days of the original date of purchase.
All returns are subject to a 20% restocking fee at our discretion. All
items returned must be in perfect, "new" condition, and in the original
packaging. It is the customer's responsibility to package all returned
merchandise well enough to prevent damage during the return shipment.
To initiate a return or exchange, call ToeOut Performance Systems
Inc. to obtain a Returned Goods Authorization Number (RGA#). The RGA#
MUST be clearly marked on the outside of the package near your return
address. Packages WILL NOT be accepted without prior authorization.
All returns must include a copy of the original invoice and return
shipping must be prepaid. CODs are NOT accepted.
ToeOut Performance Systems Inc. is not responsible for any installation
labor charges on products which are damaged, defective, or ordered
in error.
Prices
Prices are subject to change without notice. The prices charged will
be those prevailing at the time of shipment. Product specification and
design, availability, and pricing are all subject to change without
notice.
Product Changes
ToeOut Performance Systems Inc. and its suppliers reserve the unconditional
right to change the design, materials, specifications, and suppliers
of any product cataloged by ToeOut Performance Systems Inc. without
incurring any liability or obligation to the purchasers of any such
product.
Warranties
All items sold by ToeOut Performance Systems Inc. are warranted to be
free from defects in manufacture, material and workmanship prior to
installation. Any alteration or improper use will void this warranty.
This warranty is limited, at our option, to the replacement, repair
or credit of the defective merchandise. The determination for all warranty
claims will be at our sole discretion. This warranty does not cover
any direct or indirect costs, such as labor, arising from the use of
our products. To warranty a defective product, return the defective
unit to us at your expense. Upon verification of warranty coverage,
a refund will be issued within 30 days. All competition and racing parts
are sold "AS IS" without any warranty. Implied warranties including
warranties of merchantability or fitness for a particular purpose are
excluded. We have properly presented the required pre-sale notification
of our warranty terms. We are neither liable nor responsible for ascertaining
whether those terms have been read by our customers.

Use of the names and manufacturer logos Audi® BMW®, MINI®, Cooper®, Volkswagen®,
VW® and others referred to herein are trademarks or registered trade
names of their respective companies or mark holders and used for descriptive
purposes only. ToeOut Performance Systems Inc. is not associated with
or endorsed by Audi AG, BMW AG, Volkswagen AG, Audi of America, BMW
of North American, MINI of North America or Volkswagen of America.
